Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of customfencesigns.com (the "Site") and any products or services offered by Custom Fence Signs ("we," "us," or "our"). By using the Site or placing an order, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to place an order.

3. Orders, Proofs & Production

  • All orders are subject to acceptance and availability.
  • A design proof is sent for approval before production begins. Production timelines start after written approval.
  • Typical turnaround is approximately 5–7 business days after proof approval, plus shipping time. Timelines are estimates and not guaranteed.
  • You are responsible for the accuracy of all order details, including spelling, phone numbers, colors, sizes, and uploaded artwork.

4. Pricing & Payment

Prices are listed in U.S. dollars and may change at any time. Payment is required in full at the time of order unless otherwise agreed in writing. You authorize us to charge your selected payment method for the total amount, including any applicable taxes and shipping fees.

5. Custom & Personalized Products

Because our products are custom-manufactured to your specifications, all sales are final once a proof has been approved. We do not accept returns or offer refunds for buyer's remorse, color preference, or errors approved on the proof.

6. Defects, Damages & Replacements

If your order arrives damaged, defective, or materially different from the approved proof, contact us at orders@customfencesigns.com within 14 days of delivery with photos. We will, at our option, reprint, replace, or refund the affected items. Our liability is limited to the price you paid for the affected items.

7. Shipping & Risk of Loss

Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for carrier delays, misdelivery, or loss after handoff, though we will assist with carrier claims when reasonably possible.

8. Intellectual Property

  • You retain ownership of any artwork, logos, or content you upload ("Customer Content"), and you grant us a non-exclusive license to use, reproduce, and modify the Customer Content solely to produce and fulfill your order.
  • You represent and warrant that you own or have all necessary rights to the Customer Content and that it does not infringe any third-party rights or violate any law.
  • You agree to indemnify and hold us harmless from any claim arising from the Customer Content.
  • All Site content, templates, designs, trademarks, and software not provided by you remain our property or that of our licensors.

9. Prohibited Content

We reserve the right to refuse any order containing content that is unlawful, infringing, threatening, harassing, hateful, sexually explicit, or otherwise objectionable in our sole discretion.

10. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Slight variations in color, size, and material finish are normal and do not constitute a defect.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Custom Fence Signs and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your Customer Content, or your violation of these Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of the United States and the state in which we are headquartered, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

14. Changes to These Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
